Terms of service

1. Overview

This website is operated by Mule Gear Systems Inc. Throughout the site, “we,” “us,” and “our” refer to Mule Gear. By visiting this site and/or purchasing from us, you agree to these Terms of Service.

Mule Gear builds precision aluminum storage systems designed to fit specific truck models. Each product is custom-made using third-party 3D-scan data, fabricated to order, and assembled by the customer or their chosen installer.

By placing an order, you confirm that you have read, understood, and accepted all terms listed here.

2. Product Nature and Intended Use

Mule Gear systems are designed as cargo organization and storage equipment, not as passenger seating or safety structures.

Products are not tested or certified for crashworthiness, occupant protection, or highway use with passengers in modified areas. These systems are intended for off-road or job-site use at slow speeds, or for stationary organization.

3. Installation Responsibility

Mule Gear does not offer or perform installation services and does not certify the work of any third-party installers.

By purchasing and installing a Mule Gear product, you accept full responsibility for proper installation, alignment, torqueing, and safety verification. Mule Gear is not liable for any injury, property damage, or vehicle damage resulting from installation, re-installation, or removal of any product.

A signed or digital acknowledgement confirming that you assume full installation liability is required before production begins.

4. Orders and Production

All Mule Gear units are made to order based on verified truck details provided by the customer. Once production begins, all sales are final.

Mule Gear may request photos of your rear-seat area to confirm cab configuration. If your truck differs from the scanned model, production may be delayed or canceled. By approving production, you accept that your truck may differ from our scan data and agree that Mule Gear is not responsible for any incompatibility resulting from unverified differences.

Mule Gear reserves the right to refuse or cancel orders if inaccurate information, suspected fraud, or unauthorized use is detected.

5. Guarantees and Limitations

Mule Gear offers two guarantees:

  • Like-A-Glove Fit: Designed to fit within 5/8 inch (16 mm) of your truck’s interior contours. Minor factory variances or modifications may affect fit.
  • Rattle-Free Guarantee: When installed as instructed, using approved hardware, thread treatments, and torque values, the unit will not rattle.

These guarantees cover fit and noise performance only. They do not imply or extend to structural strength, crash safety, or occupant protection.

Improper installation, over-torqueing, omission of parts, use of non-approved hardware, or installation in modified vehicles voids all guarantees.

6. Testing and Certifications

Mule Gear conducts internal tests for product development and quality assurance. These tests are not certifications of load capacity, crash performance, or compliance with CMVSS, FMVSS, or any other standards.

No claim is made that Mule Gear products provide occupant restraint or vehicle safety functions.

7. Intellectual Property

All designs, CAD files, logos, names, slogans (including “Never Half-Ass’d”), product configurations, and branding are the exclusive property of Mule Gear Systems Inc.

No product, image, or design may be copied, distributed, or reproduced without written permission from Mule Gear.

8. Limitations of Liability

To the fullest extent permitted by law, Mule Gear’s liability for any claim is limited to the original purchase price of the affected product. Mule Gear is not responsible for incidental, consequential, special, or punitive damages.

Mule Gear is not liable for injuries, losses, or damages resulting from:

  • Improper installation or removal
  • Use of the product as seating or for passenger transport
  • Alteration of OEM safety systems or seat-belt anchors
  • Use outside intended design (including highway travel with passengers)
  • Unauthorized modifications or third-party accessories

9. Indemnification

By purchasing, installing, or using a Mule Gear product, you agree to indemnify and hold harmless Mule Gear, its employees, and affiliates from any claim, loss, or liability (including legal fees) arising from misuse, improper installation, modification, or use outside of provided instructions.

10. Dispute Resolution and Governing Law

All disputes, claims, or controversies shall be resolved by binding arbitration conducted in Edmonton, Alberta, under Alberta law.

Class or representative actions are waived. The prevailing party in arbitration may recover reasonable legal fees and costs.

11. Changes to Terms

Mule Gear reserves the right to update or change these Terms of Service at any time without prior notice. Updates take effect immediately upon posting on this page.
